Welcome to My Roomie. These Terms & Conditions govern your access to and use of the My Roomie platform and services.

By creating an account, accessing the platform, creating a profile, requesting or accepting a match, making a payment, communicating with another user, or otherwise using My Roomie, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.

1. What My Roomie Is

My Roomie is an independent accommodation and roommate discovery platform designed to help students and learners discover and connect with other people who may be suitable roommates, accommodation partners, hosts, or temporary accommodation contacts.

My Roomie is intended to support students and learners throughout different stages and circumstances of their academic journey. This may include ordinary semester accommodation, moving to another campus or town, attachment, internship, practicum, teaching practice, hackathons, competitions, conferences, trainings, graduation, long holidays, supplementary or special examinations, changing accommodation, or temporary stays.

My Roomie may also allow a student or learner who already has accommodation to indicate that they may be willing to accommodate another person for an agreed period.

My Roomie facilitates discovery and introductions between users. We do not own, lease, manage, inspect, operate, guarantee, or control the houses, apartments, hostels, rooms, landlords, roommates, hosts, guests, or other accommodation arrangements that users may discover through the platform.

A successful match or connection does not constitute a tenancy agreement, lease, partnership, employment relationship, agency relationship, hosting agreement, or any other legal relationship between My Roomie and either user.

2. Independence From Educational Institutions

My Roomie is an independent, privately operated platform and is not an official service, department, project, or representative of any university, college, KMTC, polytechnic, TVET institution, Teacher Training College (TTC), or other educational institution.

Unless expressly stated otherwise through a formal written agreement, My Roomie is not owned, operated, endorsed, sponsored, administered, authorized, accredited, or officially affiliated with Maasai Mara University, the University of Nairobi, Jomo Kenyatta University of Agriculture and Technology, or any other university, college, KMTC, polytechnic, TVET institution, TTC, educational body, student organization, or government institution.

References to universities, colleges, KMTC institutions, polytechnics, TVET institutions, TTCs, campuses, student communities, geographical areas, or other educational institutions on My Roomie are intended only to identify communities or geographical audiences for which the platform may be available or relevant.

Such references do not constitute a representation that the identified institution has approved, endorsed, partnered with, sponsored, authorized, accredited, or assumed responsibility for My Roomie.

Users expressly acknowledge and agree that My Roomie is not an official service of any university, college, KMTC, polytechnic, TVET institution, TTC, campus, or other educational institution. The use of My Roomie by students or learners from an institution does not create any agency, partnership, endorsement, sponsorship, employment, representation, or other institutional relationship between My Roomie and that institution.

Where the platform displays institutional names, campus information, colours, logos, marks, or other identifying material, such material must not be interpreted by users as evidence of official institutional endorsement, ownership, sponsorship, authorization, or partnership unless My Roomie expressly identifies such relationship as existing under a formal written agreement.

My Roomie does not represent that it speaks on behalf of, represents, or has authority to act for any university, college, campus administration, KMTC institution, polytechnic, TVET institution, TTC, student organization, or other institution unless such authority has been expressly granted in writing.

The fact that students or learners from a particular institution or campus may register for, use, recommend, or participate in My Roomie does not make that institution responsible for My Roomie, its operators, its users, or any transaction, communication, meeting, accommodation arrangement, dispute, loss, injury, fraud, or other event arising from use of the platform.

Institutional Concerns and Requests for Disassociation

My Roomie respects the independence, identity, intellectual property, reputation, and institutional interests of universities, colleges, KMTCs, polytechnics, TVET institutions, TTCs, and other educational institutions.

If an institution, rights holder, or authorized representative believes that any reference, branding, logo, colour scheme, institutional description, or other material appearing on My Roomie creates confusion regarding affiliation, endorsement, sponsorship, authorization, or ownership, the institution or authorized representative may contact My Roomie at support@myroomie.site with details of the concern.

Upon receiving a legitimate institutional request, My Roomie will review the relevant material and, where appropriate, take reasonable steps to clarify, correct, modify, remove, or otherwise address the material in question.

Submission of a request does not automatically establish that My Roomie has infringed any right or that the institution has accepted responsibility for the platform. Any such matter will be considered and handled in accordance with applicable Kenyan law and any applicable agreements or rights.

Nothing in this section grants My Roomie permission to use any institution's trademarks, logos, copyrighted materials, or other protected intellectual property where such permission is otherwise required.

My Roomie may obtain, modify, or discontinue the use of institutional branding or references where legally required, where requested by an appropriate rights holder, or where it determines that doing so is appropriate.

My Roomie may identify particular institutions or campuses as communities served by the platform for purposes of organizing users, matching users, providing institution-specific functionality, or describing the platform's intended audience. Such identification does not by itself constitute an official relationship with the identified institution.

Users must not claim or imply that My Roomie is an official institutional service, nor may users represent themselves as authorized representatives of My Roomie or of any institution merely because they use, promote, or interact with the platform.

My Roomie operates independently and answers to the laws of the Republic of Kenya. It does not operate under the authority or disciplinary jurisdiction of any individual university, college, campus, KMTC, polytechnic, TVET institution, TTC, or other educational institution.

Nothing in these Terms prevents My Roomie from complying with lawful requests, court orders, investigations, intellectual-property rights, regulatory requirements, or other obligations imposed by competent authorities under Kenyan law.

3. Respect for Educational Institutions and Communities

My Roomie is intended to provide a useful and responsible platform for students and learners. The platform is not intended to be used as a channel for campaigns, disputes, harassment, or content designed to unfairly damage the reputation of an educational institution or student community.

By using My Roomie, you agree not to use the platform to intentionally publish, promote, or distribute false, malicious, misleading, abusive, defamatory, or deliberately disparaging statements about any university, college, KMTC, polytechnic, TVET institution, TTC, campus, student community, staff member, administrator, or other educational body.

Users must not use My Roomie to organize harassment, targeted abuse, malicious campaigns, impersonation, coordinated attacks, or other conduct intended to unfairly portray an institution or its community in a negative light.

Nothing in this section is intended to prevent a user from making a truthful report, raising a genuine safety concern, reporting suspected fraud or misconduct, seeking assistance, or providing a good-faith account of their personal experience where permitted by applicable law.

My Roomie may remove content, restrict accounts, or take other reasonable enforcement action where content or conduct violates these Terms, applicable law, or the safety and integrity of the platform.

4. Trademark, Branding and Intellectual Property

My Roomie respects the intellectual property rights of universities, institutions, organizations, businesses, individuals, and other rights holders.

University and institutional names, logos, seals, crests, emblems, colours, slogans, designs, photographs, and other identifying materials may be protected by trademark, copyright, institutional policy, or other legal rights. Unless expressly authorized, My Roomie does not claim ownership of such third-party materials.

Any third-party name, mark, logo, colour scheme, or other identifying material displayed on the platform is used only for the purpose represented on the platform and does not, by itself, indicate ownership, endorsement, sponsorship, accreditation, partnership, authorization, or official affiliation.

Where My Roomie receives written permission or enters into an agreement with an institution or other rights holder, the relevant material may be used subject to the scope, conditions, duration, brand guidelines, and other restrictions specified by that rights holder.

My Roomie may remove, modify, replace, or discontinue any third-party intellectual property or branding where the relevant rights holder requests it, where continued use could reasonably create confusion, or where removal is required by applicable law or agreement.

Users may not copy, reproduce, modify, distribute, or use My Roomie's name, logo, software, interface designs, content, or other proprietary materials except as permitted by law or with appropriate authorization.

Nothing in these Terms grants any user or third party a license or other proprietary right to any university's, institution's, or other third party's intellectual property.

Questions, permission requests, trademark concerns, takedown requests, and institutional branding matters may be directed to support@myroomie.site.

5. Eligibility

My Roomie is primarily intended for adults who are students or learners in higher-learning and tertiary institutions.

You must be at least 18 years old to use My Roomie independently.

If you are under 18 years of age, you may only use My Roomie where such use is permitted by applicable law and where you have obtained the written and signed consent of your parent or legal guardian before using the platform.

Where requested by My Roomie for safety, compliance, or verification purposes, an under-18 user may be required to provide appropriate evidence of the parent or legal guardian's consent. My Roomie may restrict or suspend an account where the required consent cannot be reasonably established.

A parent or legal guardian providing consent on behalf of a minor is responsible for understanding the nature of the platform and the activities for which consent is being provided.

Users must provide accurate information about their age and other account details. Providing false information about your age or identity may result in suspension or termination of your account.

Student verification is optional and manual. If you submit a school ID or admission letter, an authorized administrator or campus ambassador assigned to your campus may review it to decide whether to award a campus verification badge. The document is deleted from active storage when the reviewer records a decision. The badge only reflects that campus evidence was reviewed; it does not verify gender or every claim, guarantee identity or behaviour, or certify that a student is trustworthy. You remain responsible for using good judgment when interacting with other users.

If you are using My Roomie as a student or learner, you are responsible for ensuring that your use of the platform does not violate any applicable rules, agreements, accommodation policies, institutional requirements, or other obligations that independently apply to you.

6. User-Provided Information

Most information displayed on user profiles is provided directly by users. My Roomie does not guarantee that information supplied by users is accurate, complete, current, or truthful.

We may take reasonable measures to identify suspicious, fraudulent, abusive, or prohibited activity, but such measures do not constitute a guarantee that every profile or user has been independently verified.

A profile appearing on My Roomie should not automatically be treated as proof of identity, character, financial ability, student status, ownership of property, accommodation rights, or legitimacy.

7. No Guarantee of Identity or Compatibility

My Roomie does not guarantee that a person is who they claim to be, that they are genuinely looking for a roommate or accommodation, that their preferences are accurate, or that they will be compatible with another user.

Matching is based on information supplied by users and the functionality of the platform. A match is not a recommendation, endorsement, or guarantee of compatibility or safety.

8. Your Safety Is Your Responsibility

Your personal safety and the safety of your property ultimately remain your responsibility.

We encourage every user to exercise reasonable caution and conduct independent due diligence before meeting, communicating privately, sharing personal information, transferring money, viewing a property, accepting accommodation, offering accommodation, or agreeing to live with another person.

For your safety, you should:

• Meet potential roommates or hosts in a safe and public location.
• Tell a trusted person where you are going.
• Verify the identity of the person you are meeting.
• Inspect accommodation personally before making commitments.
• Verify landlords, agents, property ownership, and rental or hosting terms independently.
• Never disclose your passwords, M-Pesa PIN, or authentication credentials.
• Be cautious when sending money to another user.
• Report suspicious, threatening, fraudulent, or abusive behaviour.

If you believe you are in immediate danger, contact the appropriate emergency or law-enforcement authorities rather than relying on My Roomie to provide emergency intervention.

9. No Housing, Landlord, Host, or Roommate Guarantee

My Roomie does not guarantee that any room, house, hostel, landlord, host, roommate, property listing, rental price, hosting rate, location, or accommodation arrangement is genuine, legal, available, safe, suitable, or accurately described.

Users are responsible for independently verifying any accommodation, hosting, rental, or living arrangement before entering into an agreement or transferring money.

Where a user offers temporary accommodation or hosting, the terms of that arrangement, including duration, amount payable, payment method, house rules, responsibilities, and termination conditions, should be agreed directly between the relevant users.

10. Contact Information and Matching

Where My Roomie provides a matching system, contact information may be disclosed according to the matching rules communicated on the platform.

Users must not deliberately place phone numbers, WhatsApp numbers, email addresses, social-media handles, payment instructions, or other direct-contact information into fields that are intended to remain public or restricted.

Attempts to bypass platform controls, payment requirements, moderation systems, or matching mechanisms may result in suspension or termination of an account.

11. Payments and Fees

Where a matching or connection fee applies, the applicable amount and payment instructions will be displayed before payment is requested.

A matching process may involve different fees for the requesting user and the receiving or confirming user. The exact amounts, deadlines, and conditions may change and will be displayed by the platform at the relevant time.

Unless otherwise stated by My Roomie, fees paid for a successfully approved connection are non-refundable once the relevant service has been provided.

Matches that are not completed or confirmed within the applicable period may expire automatically.

My Roomie does not guarantee that a paid connection will result in a successful roommate arrangement, tenancy agreement, hosting arrangement, friendship, continued communication, or any other outcome beyond the specific service purchased.

12. Prohibited Activities

You must not use My Roomie to:

• Create fake or misleading profiles.
• Impersonate another person or organization.
• Commit, facilitate, or attempt fraud.
• Harass, threaten, stalk, intimidate, or abuse another user.
• Publish sexually explicit, exploitative, or unlawful content.
• Solicit or facilitate illegal activities.
• Attempt to obtain another person's passwords, PINs, or credentials.
• Misuse another person's personal information.
• Attempt to circumvent platform payment or matching systems.
• Use the platform for spam or unauthorized commercial solicitation.
• Upload malicious software or attempt to compromise the platform.
• Use the platform to maliciously, falsely, or misleadingly disparage educational institutions or their communities.
• Organize harassment, targeted abuse, or coordinated malicious campaigns against an institution, student community, or individual.
• Use the service for any purpose prohibited by Kenyan law.

13. Moderation and Enforcement

We reserve the right to review reports, investigate suspected abuse, restrict content, suspend accounts, remove profiles, cancel matches, restrict access, or permanently ban users where we reasonably believe that these Terms, our Privacy Policy, platform rules, or applicable law have been violated.

We may also take action to protect users, investigate suspected fraud, maintain platform security, protect institutional or third-party rights, or comply with lawful requests from competent authorities.

We are not required to provide advance notice where immediate action is reasonably necessary to protect users, the platform, or third parties.

14. User Responsibility for Content

You are responsible for the information, photographs, messages, descriptions, opinions, and other content you submit to My Roomie.

You must have the necessary rights and permissions to submit content that you upload. You must not upload information belonging to another person without appropriate authorization.

You must not knowingly submit false, fraudulent, malicious, defamatory, threatening, or misleading information about another person, accommodation, institution, or organization.

15. No Guarantee of Continuous Availability

We aim to keep My Roomie available and reliable, but we do not guarantee uninterrupted or error-free operation.

The platform may occasionally be unavailable because of maintenance, upgrades, technical failures, third-party service interruptions, security incidents, network problems, or circumstances outside our reasonable control.

16. Third-Party Services

My Roomie may rely on third-party services for hosting, authentication, databases, payments, messaging, analytics, security, communications, or other technical functionality.

Third-party services may have their own terms and privacy policies. Your use of those services may therefore be subject to their respective terms in addition to these Terms.

17. Limitation of Liability

To the maximum extent permitted by applicable law, My Roomie and its operators, developers, contributors, and representatives will not be responsible for losses, damages, injuries, disputes, fraud, theft, property damage, financial loss, emotional distress, or other harm arising from interactions, transactions, meetings, accommodation arrangements, hosting arrangements, or relationships between users.

This includes circumstances where a user is misled, defrauded, harmed, or otherwise negatively affected by another user, landlord, host, agent, property owner, or third party.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

18. Assumption of Risk

By using My Roomie to discover and communicate with other people, you acknowledge that interactions with strangers and decisions concerning accommodation carry inherent risks.

You voluntarily assume responsibility for evaluating those risks and making your own decisions regarding whether, when, where, and how to interact with another user.

My Roomie provides the connection; the decision to trust, meet, transact, host, stay with, or live with another person remains yours.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of My Roomie, your violation of these Terms, or your violation of another person's rights.

20. Reporting Problems

If you encounter a fake profile, scam, harassment, threatening behaviour, inappropriate content, privacy concern, institutional impersonation, or other violation, please report it through the available reporting or support mechanisms.

Reports help us investigate and take appropriate action, but submitting a report does not guarantee that an account will be removed or that a particular outcome will occur.

21. Privacy

Your use of My Roomie is also governed by our Privacy Policy, which explains how we collect, use, protect, retain, and disclose personal information.

22. Changes to the Service

My Roomie may introduce, modify, suspend, or discontinue features, services, fees, matching mechanisms, or other aspects of the platform at any time.

Where changes materially affect these Terms or your rights, we will take reasonable steps to notify users where appropriate.

23. Changes to These Terms

We may update these Terms from time to time. The updated version will display a revised "Last updated" date.

Where continued use of the platform after an update constitutes acceptance under applicable law, your continued use of My Roomie after the effective date of the updated Terms constitutes acceptance of the revised Terms.

24. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Republic of Kenya, subject to applicable legal requirements.

Any dispute concerning the use of My Roomie shall be handled through the appropriate legal and judicial mechanisms available under Kenyan law.

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where possible, and the remaining provisions will continue to apply.

26. Entire Agreement

These Terms, together with the Privacy Policy and any additional rules or notices expressly incorporated into the platform, constitute the principal terms governing your use of My Roomie.

27. Our Commitment

My Roomie was created in good faith with the intention of making it easier for students and learners to find compatible roommates, accommodation, and temporary living arrangements throughout their academic journeys.

We will make reasonable efforts to maintain a responsible platform, protect user information, respond to legitimate reports, remove prohibited content, respect the independence of educational institutions, and improve the safety and reliability of the service.

However, no online platform can eliminate every risk associated with interactions between people. We therefore encourage every user to exercise independent judgment, caution, and due diligence.

My Roomie provides a platform for discovery and connection. We do not control what another person may do after being introduced through the platform. Ultimate responsibility for personal safety, decisions, transactions, accommodation arrangements, and real-world interactions remains with the relevant users.

My Roomie is built in good faith to provide a practical service to students and learners. Our goal is to make it easier for people to find suitable accommodation connections while operating responsibly, independently, and in accordance with applicable law.
